Policy Statement on Intellectual Property, Disclosure, and Material Use
Effective [Updated May 2023]
PixelFix Films, LLC is committed to safeguarding the integrity, originality, and commercial value of all creative content, digital assets, film productions, and intellectual property (IP) produced, commissioned, or distributed under its name. This policy establishes the conditions under which PixelFix Films’ services may be used and outlines strict limitations regarding the handling, disclosure, licensing, and replication of company materials.
1. Scope of Services, Exclusivity, and Client Eligibility
PixelFix Films provides social media management, email marketing campaigns, and film and photographic services exclusively to active website clients whose sites are hosted, maintained, and operated directly by PixelFix Films.
PixelFix Films does not work with, integrate with, support, or produce creative assets for any third-party web companies, outside developers, external hosting platforms, or competing web service providers. Clients must utilize PixelFix Films as their sole website platform in order to receive any associated media, marketing, or production services.
Should a client transition their website to another provider, platform, or developer, or otherwise discontinue PixelFix Films as their website-management partner, all services—including social media, email marketing, film production, and photographic services—immediately terminate, and all prepaid balances are irrevocably forfeited. No refunds, transfers, or credits will be issued.
2. Intellectual Property Rights and Licensing Restrictions
All creative works—including designs, scripts, motion graphics, films, digital assets, photographic materials, branding, and written content—produced by or for any client of PixelFix Films are the exclusive intellectual property of PixelFix Films, LLC or its licensed partners.
Most, though not all, film footage and photographic content supplied by PixelFix Films is licensed exclusively to PixelFix Films, is non-transferable, and may not be used on any other website, platform, print medium, social media account, or marketing outlet without the company’s advance written authorization. Clients are expressly prohibited from transferring, copying, sublicensing, or repurposing these materials for use with any other agency, developer, or platform.
Unauthorized reproduction, adaptation, distribution, or public display of these materials constitutes a violation of this policy and may result in legal action.
3. Non-Disclosure and Confidentiality
All proprietary, confidential, pre-release, or unpublished materials must be protected with the highest degree of confidentiality. Employees, contractors, collaborators, and clients are strictly prohibited from sharing or disclosing such content without written authorization from PixelFix Films. Any breach—whether intentional or negligent—may result in immediate contractual and legal consequences.
4. Improper or Unauthorized Use of Materials
PixelFix Films’ materials may only be used for the specific, authorized purpose for which they were created. Any repurposing, alteration, redistribution, or adaptation without explicit written consent is strictly prohibited. This includes but is not limited to:
Using film or photographic assets in unrelated or external projects
Republishing materials on third-party platforms or with outside agencies
Modifying or reverse-engineering proprietary tools or digital products
Extracting design elements or assets for use by other vendors
Attempting to transfer usage rights or licenses to another entity
5. Prohibition of Bad-Faith Use
Any use of company content in bad faith—including deceptive, misleading, misrepresentative, or unfair competitive practices—is grounds for immediate legal action. Examples include altering metadata, misrepresenting authorship, impersonating PixelFix Films personnel, or exploiting proprietary content to benefit another provider or competitor.
6. Replication, Derivative Works, and AI-Based Duplication
Replication or imitation of PixelFix Films’ materials—whether through manual means or technologies such as AI training, duplication, machine learning, or style transfer—is strictly prohibited. Clients and third parties may not generate derivative works that imitate the style, structure, composition, narrative, or conceptual foundation of PixelFix Films’ IP for personal or commercial use.
7. Enforcement and Consequences
Violations of this policy will result in immediate and enforceable corrective measures, including contract termination, forfeiture of prepaid services, financial restitution, and legal proceedings. PixelFix Films, LLC reserves the right to audit the use, distribution, and storage of its materials at any time to ensure compliance.
